Supreme Court Intervention Could Increase Innovative Drug Maker Patent Pressure

Key View: Should the Supreme Court agree to hear the AIDS Healthcare Foundation's lawsuit against Gilead Sciences, it will answer a question over whether consumers rather than just manufacturers can sue over allegedly invalid patents. This could potentially speed up access to generic versions of patented drugs and reduce litigation costs for generic manufacturers. However, given the number of cases petitioned to the Supreme Court, it is unlikely that the case will be heard.
