In our Fifth Annual Patent Intelligence Report, aside from our popular performance and activity rankings for patent firms, companies and attorneys in high-tech, bio-tech and overall, for the first time, we have evaluated patent attorneys and agents by taking into consideration their number of patents as well as interviews with the USPTO examiners. The report also includes:

  • the estimated patent revenue generated by each of the top 2,000 patent firms
  • the estimated patent spending for each of the top 2,000 companies
  • the estimated patent revenue generated by each of the top 2,000 patent attorneys or agents
  • the top 3 patent clients for each of the top 2,000 most active patent firms
  • the top 3 patent firms for each of the top 2,000 most active compies
  • the top 3 patent clients for each of the 2,000 most active attorneys

Our reports help companies leverage the data with the goal of either trimming their patent firms or in some cases, adding a new firm to help with their ongoing patent prosecution needs.

Similar to our other reports, we looked at a five-year period based on the issue dates between January 1st, 2018 and December 31st, 2022 to measure the activity, efficiency and performance of law firms. This year, we evaluated:

  • 2,332,609 applications
  • 1,846,457 Patents
  • 27,826,561 Claims 
  • 130,458 Companies
  • 3,429 Patent Firms
  • 30,777 Active Patent Attorneys and Agents

This year for the first time, thanks to our automation of data extraction process, we have considered interview data in addition to patent applications when calculating attorney and agent rankings. Tens of thousands of documents were used to train our algorithms in order to perform the attorney name extraction from millions of documents available through the USPTO Public PAIR.

Similarly as in other reports, for the first time this year, we have included a section reviewing the important lateral moves that took place during 2022 and early 2023. This section features attorneys from the top 2,000 most active list who have made a move or established their own firm since the release of our 2022 report.

In order to come up with the list of top law firms, we analyzed and reviewed various metrics including filing activity, the pendency of applications, number of extensions requested, number of office actions, allowance rate, changes in the claim language and length of the claims. We compared these metrics and measured them against the average for different firms as well as Art Units at the USPTO. 

We looked at the data in three different areas: high-tech, bio-tech and overall to make sure our comparison is fair and those firms focusing on only one area are treated fairly. The top 100 firms in different categories that purchase the report, will also receive our 2023 report badges.
