In our Second Annual Patent Prosecution  Intelligence  Report, other than our popular rankings of law firms based on activity and performance, we plan to add new sections to provide fresh analysis on:

  • The average and estimated cost of filing different types of patent applications and Office Action responses 
  • Some of the challenges patent attorneys are facing in today's environment, including profitability, talent acquisition and business development
  • Other trends and statistical information about the prosecution process such as prior art searches, outsourcing, use of AI, etc.

Our first report helped some companies to leverage the data with the goal of either trimming their patent firms or in some cases, adding a new firm to help with their ongoing patent prosecution needs.

Similar to our other reports, we will look at a five year period based on the filing dates between January 1st, 2015 and December 31st, 2019 to measure the activity, efficiency and performance of law firms. 

In order to come up with the list of top law firms, we will analyze and review many different metrics including filing activity, the pendency of applications, number of extensions requested, number of office actions, allowance rate, changes in the claim language and length of the claims. We will compare these metrics and measure them against the average for different firms as well as Art Units at the USPTO. 

We will look at the data in three different areas: high-tech, bio-tech and overall to make sure our comparison is fair and those firms focusing in only one area are treated fairly. The top 100 firms in different categories that purchase the report, will also receive our 2020 prosecution badges.

We also plan to provide an ability for law firms to directly verify their workload on the site and upload or download their applications. Since in some cases, the filing is done under the name of their clients, we thought this will provide them with an opportunity to complete their applications in case some are missing.

Some interesting facts from this report include the followings (5 year period):

  • More than 3500 law firms have represented more than 110,000 companies before the USPTO
  • More than 2 million patent applications have been filed
  • More than 10,000 examiners have examined these applications in more than 600 art units
  • Over 100,000 entities have applied for a patent application in the US.

Similar to other reports, we will provide a Press Kit and the firms will be able to have a press release or publish the digital badges on their sites.

In addition, due to popular demand, similar to last year, we will provide an Excel file covering the first 1000 law firms, with all their stats and scores for the last five years.
