Nokia and OPPO Reach a 5G Patent Cross-License Agreement

In a significant development for the global telecommunications industry, Nokia and OPPO have announced a multi-year patent cross-license agreement, marking the end of a prolonged legal dispute over 5G patent infringements. This resolution not only settles all pending litigation between the two tech giants but also sets a precedent for future collaboration and innovation in the 5G domain.

Background of the Dispute

The conflict originated in 2021 when Nokia accused OPPO of infringing on its 5G patents and failing to renew their licensing agreement that expired in mid-2021. Nokia's decision to take legal action in several countries was met with counter-lawsuits by OPPO, leading to an exit of OPPO and its affiliate BBK companies from the German market. This legal case highlighted the critical importance of patent agreements in the tech industry, especially as companies navigate the complex landscape of 5G technology.

Terms of the Agreement

While the specific terms of the agreement remain confidential, it is known that OPPO will make royalty payments to Nokia. These payments include compensation for the period of non-payment during the dispute. Nokia anticipates recognizing net sales from this agreement starting Q1 2024. This agreement not only benefits both companies financially but also underscores the value of mutual respect for intellectual property in fostering industry-wide innovation.

Impact on the Industry

Nokia, with a patent portfolio built on more than €140 billion invested in R&D since 2000, stands as a key player in the telecommunications field. Its collection includes over 20,000 patent families, with more than 6000 deemed essential for 5G technology. OPPO, on the other hand, has made significant progress in 5G, operating in over 60 countries and regions.

Future Collaborations and Innovations

The resolution of this dispute opens new approach for cooperation between Nokia and OPPO, two major forces in the global smartphone market. Both companies have expressed their enthusiasm for future collaborations that will drive innovation and bring advanced technologies to users worldwide.
This agreement also reinforces the importance of fair, reasonable, and non-discriminatory (FRAND) licensing practices in promoting technological advancements and competition in the industry.

As the world continues to advance towards more sophisticated 5G technologies, such partnerships are crucial for the development of innovative products and services that meet the growing demands of consumers worldwide.
